Part A covers anyone using this website. Part B covers businesses that hire Persmon Marketing for marketing services. Where a term below says [Owner to confirm: …], that detail has not been decided yet and will be set out in your written proposal.
Part A: Using this website
1. About these terms
These terms apply to your use of marketing.persmontechnologies.com, run by Persmon Technologies Limited, trading as Persmon Marketing, Mukwano Courts, William Street, Kampala, Uganda. By using the website you agree to them. If you do not agree, please do not use the website.
2. Packages, estimates and proposals
Packages on this website describe how we usually work and are discussed on a free call. They are not an offer. The plan quiz, enquiry estimator and retainer configurator give a rough guide from the answers and numbers you enter; they are not quotes or forecasts. The services, price, timeline and payment schedule for any work are set only in a written proposal or agreement accepted by both sides, and that document prevails over anything on the website.
3. Work shown on the website
Websites shown on this site were designed and built by Persmon Technologies. They show website work, not marketing results. Client names, logos and trademarks belong to their owners and are shown to describe our work. Live client websites are run separately and may change after we finish our work. Anything marked as example data is illustrative and does not describe a real business or result.
4. Using the website
- Do not misuse the website: no attempts to break security, overload the servers, scrape it at scale, or send spam through our forms.
- Information you send through our forms must be accurate and yours to share.
- We may change, suspend or remove any part of the website at any time.
5. Intellectual property
The text, design, graphics and code of this website belong to Persmon Technologies Limited or our licensors. You may view and share pages for personal or internal business use, but you may not copy or republish substantial parts without our written permission.
6. Content accuracy and liability
We work to keep information on the website accurate, but it is general information and not professional advice for your situation. To the extent the law allows, we are not liable for loss arising from reliance on website content or from the website being unavailable. Nothing in these terms limits liability that cannot be limited by law.
7. Links
Links to other websites are provided for convenience. We do not control those sites and are not responsible for their content.
8. Privacy
How we handle personal data is described in our privacy policy.
Part B: Marketing services
9. Your proposal comes first
When you hire us, the services, fee and timings are set out in a written proposal or agreement. These terms apply alongside it. If the two differ, the signed proposal or agreement wins.
10. Retainers and scope
A monthly retainer covers the services listed in your proposal. Work outside that list is quoted separately before we start it. Minimum retainer term: [Owner to confirm: minimum term, if any].
11. Fees and payment
Invoicing and payment: [Owner to confirm: when invoices are sent, when payment is due, currency and accepted payment methods]. Late payment: [Owner to confirm: what happens if an invoice is paid late].
12. Ad spend is paid directly to the platforms
Our fee does not include advertising budgets. Ad spend is kept separate and paid by you straight to the platform, for example Google or Meta, so you always see what was spent on ads. Each platform's own terms and advertising policies apply, and the platform decides whether an ad runs, is limited or is rejected.
13. No guaranteed results
We do not guarantee search rankings, Google Maps positions, ad performance, followers or a number of calls, messages or sales. Results depend on your market, competition, budget, offer and on platforms we do not control. We report what happened in plain language, measured in enquiries where they can be tracked.
14. What we need from you
- Access to the accounts we agree to manage, such as your Google Business Profile, social pages, ad accounts or website.
- Accurate information about your business, products, prices and opening hours, and prompt answers when we ask for approval.
- Photos, logos and other material you send must be yours to use, or used with the owner's permission.
15. Accounts and content ownership
Who owns the ad accounts, pages and content created during a retainer, and what is handed over when it ends: [Owner to confirm: ownership of accounts and content, and handover].
16. Ending a retainer
Notice period: [Owner to confirm: notice period to end a retainer, for either side]. Work in progress and fees already paid when a retainer ends: [Owner to confirm: how these are handled].
17. Confidentiality
[Owner to confirm: confidentiality terms for client business information]. Personal data is handled as described in our privacy policy.
Law and contact
18. Law
These terms are governed by the laws of Uganda, and the courts of Uganda have jurisdiction over any dispute about them.
